6.1.22 Advocacy Alert: Legislature Considering Pay Range Mandate

Today, 6/1, the New York State Senate will vote on a bill to mandate disclosure of pay ranges in job postings. The Assembly may also pass the bill in the next 48 hours.
The legislation, S.9427A/A.10477, requires that any job postings or advertisements list a range of compensation, defined as “the minimum and maximum annual salary or hourly range of compensation for a job, promotion, or transfer opportunity that the employer in good faith believes to be accurate at the time of the posting.” The bill would also require employers to keep extensive records on compensation history for each position.
The bill is modeled after a similar New York City ordinance that was set to begin in May. However, after the City Council was made aware of numerous issues with the rule, it postponed implementation until November.
If both houses pass the bill, it would take effect nine months after Governor Hochul signs it.
